Contract Renewal

At the end of the initial term, the contract is automatically renewed unless one of the parties gives notice of termination. Specifically:

  • 4+4 open-market contract: renewed for an additional 4 years;
  • 3+2 agreed rent contract: renewed for a further 2 years;
  • Transitional contract for students: renewed for the same duration as the initial term;
  • Standard transitional contract: no renewal.

JOINT TENANCY AND TENANT REPLACEMENT

If the lease is signed by all tenants living in the apartment, they are jointly and severally liable for all obligations under the contract. It’s always important to check the specific terms of the contract in advance, as procedures and conditions may vary.

For this reason, if one or more tenants decide to leave the contract, different scenarios may apply (depending on what is specified in the agreement):

  1. The contract continues with the remaining tenants
    The lease remains valid for the other tenants, who take full responsibility for all contractual obligations, including those of the departing tenant. In this case, the departing tenant is released from the contract, and the landlord must register a partial termination with the Italian Revenue Agency.
  2. Tenant replacement (“partial assignment”)
    The departing tenant can be replaced by a new tenant, provided that all parties (landlord and existing tenants) agree. This is known as a “takeover” of the contract. Since this modifies the contractual relationship, the change must be officially registered. This process does not create a new contract but updates the existing one.
  3. Contract novation
    Alternatively, the parties may choose to terminate the existing agreement and sign a completely new contract.
