General terms of access to Sais

1. Definitions

“Controller” or “Joint Controllers”: the Joint Controllers of the processing are Fondazione CEUR, with registered office at Piazza della Resistenza 9, Bologna, and ALMA MATER STUDIORUM – University of Bologna, Via Zamboni 33, 40126 Bologna.

“Sais accommodation”, “Platform”, “Portal”: the platform developed by Camplus and accessible by users through login credentials, for the purpose of accessing the services provided through the website. Access to Sais accommodation does not include the activation of any individual services, access to which may be authorised on the basis of a separate agreement entered into with the User.

“Administrator”: the person or persons who, on behalf of the Controller, may create, modify, suspend or delete access credentials, provide assistance and assign access privileges. The Administrator may suspend and/or prevent Users from accessing Sais accommodation. The Administrator may also edit, divide into separate items, merge or close posts, topics and other content submitted by Users.

“User”: any person who accesses the Platform through authentication.

“User Account”: the User’s identity used to access the Platform through their personal login credentials.

“Services”: the services accessible through authentication on the Sais accommodation Platform and which may be made available at Camplus’s discretion.

“Documents” or “Contracts”: original electronic documents or electronic copies of paper documents available on the Sais accommodation Platform and relating to the contractual relationship between Camplus and the User.

2. Purpose of Sais accommodation

The purpose of the Sais accommodation Platform is to provide online access to the services offered by Camplus through the website www.saisaccommodation.it, with the aim of facilitating contact between property owners and students.

The Sais accommodation Platform is not an advertising medium or a press publication and does not provide real estate brokerage or legal advisory services.

Users who have been issued access credentials may publish listings and view listings published by other Users exclusively for the purposes specified on the website.

3. Who May Access Sais accommodation

Access to the services and listings available on Sais accommodation is permitted only after Users have registered and authenticated themselves.

Access to the Platform is permitted exclusively to persons who are at least 18 years of age or whose access has otherwise been authorised at the sole discretion of the Joint Controllers.

Users who have previously been denied access to the Platform may not access it again.

By registering, the User declares that they meet the requirements set out in these Terms and Conditions.

4. User Authentication

During registration, Users are provided with confidential access credentials consisting of a username and password.

The password must be changed upon first access and must be kept secure and confidential. Users must not allow third parties to access their User Account or use their login credentials to access the Platform.

The User is solely responsible for their login credentials and for any use of their User Account in the event that such credentials are stolen and/or their account is accessed without authorisation.

Users may not use multiple profiles, including profiles created using different login credentials. If a User holds more than one User Account, the Administrator is entitled to delete any accounts created after the first one.

The Controller shall implement all appropriate measures within its control to prevent unauthorised access.

5. Role of the Administrator and Moderators

The Administrator may suspend and/or prevent Users from accessing the Platform, activate new login credentials, grant or terminate access to the services comprising Sais accommodation and provide assistance.

Following the publication of textual content by Users, where such content breaches these Terms and Conditions or applicable law, the Administrator may moderate the content by partially editing or deleting it (“subsequent moderation”).

The Administrator may delegate some or all of their powers to Moderators.

6. User Conduct

Camplus does not carry out any prior monitoring or moderation of content. Users are solely responsible for the content published in their listings.

Users are required to comply with these Terms and Conditions and to behave lawfully while using the Platform, including when using chat and customer care tools. Users must not use the Platform for purposes other than those specified in these Terms and Conditions.

Where the Controller becomes aware of alleged unlawful activities or information concerning a User, it shall promptly inform the competent judicial or administrative authority responsible for supervision.

At the request of the competent authorities, the Controller shall promptly provide any information in its possession that may enable the identification of the User for the purpose of detecting and preventing unlawful activities.

The disclosure or communication to third parties of personal data and information accessible through authenticated access to the Platform is prohibited. Web scraping activities are also prohibited.

The publication of special categories of personal data, as well as any information or type of listing that does not fall within the purposes of the website, is prohibited.

7. Intellectual Property

Camplus owns the intellectual property rights relating to Sais accommodation and grants Users a limited, non-exclusive licence to access and use the Sais accommodation Platform and all Services made available through it.

8. Processing of Personal Data

Pursuant to Article 13 of Regulation (EU) 2016/679, these Terms and Conditions supplement the privacy notice issued by the Data Controller with regard to the methods used to process personal data.

Users, as data subjects, may consult full information regarding the processing of their personal data in the complete privacy notice provided pursuant to Article 13 of Regulation (EU) 2016/679 by clicking Privacy Policy - Sais.

9. Updates and Duration

The Controller may amend or supplement these Terms and Conditions at any time.

It is the User’s responsibility to review the contents of these Terms and Conditions for any updates.

10. Disputes

Any complaints or disputes arising from the User’s activities on the Platform or from these Terms and Conditions shall be governed by Italian law.

The Parties agree that the Court of Bologna shall have exclusive jurisdiction over any disputes arising from or relating to the User’s activities on the Platform, these Terms and Conditions, or any matters connected thereto.

11. Liability

The Controller is not subject to any general obligation to monitor the information submitted to the Platform and shall bear no liability for any failure to monitor texts or other content submitted by Users.

The Controller has no general obligation to actively seek facts or circumstances indicating the existence of unlawful activities.
