How to withdraw from a joint contract?
All tenants occupying the apartment will be jointly and severally responsible for the obligations mentioned in the lease agreement if it is in their name.
If one or several tenants want to terminate the agreement, there may be (it is necessary to check what the individual agreement provides for such cases):
- Without any substitution or novation, the other contractors will be jointly and severally responsible for the obligations under the contract of the outgoing party with the consent of the assumption of responsibility for the obligations of the outgoing party.
- A partial assignment of the contract ("take-over") by the party who wishes to withdraw, where there is a person who wishes to take over, requires consent from all contracting parties. Completing the assignment registration with the Internal Revenue Service is necessary. Taking over the lease does not mean the lease is novated;
- The process of creating a new contract is known as contract novation.

If I find a tenant and want to take over, the act must be regular
- The contract is duly registered;
- Any previous disposals are all regular;
- The consent of the person who gives up the contract (transferor), the person who enters the contract (transferee), and the landlord (apartment owner) is necessary.
